Terms and conditions

  1. Scope of Applicability
    1. These terms and conditions govern contracts for the rental use of hotel rooms in the respective GuestHouse Mannheim for lodging purposes, as well as all other goods and services rendered by GuestHouse Mannheim to the customer in this context.
    2. The customer's general terms and conditions only apply if this is previously expressly agreed.
  2. Conclusion of contract
    1. The contract shall come into force upon GuestHouse Mannheim's acceptance of the customer's application. At its dicretion, GuestHouse Mannheim may confirm the room reservation in text form.
    2. Multiple orderer are liable as joint debtors.
    3. Any subletting or use of the studios to other purposes than mentioned in the contract requires the prior written consent of GuestHouse Mannheim. § 540 I sentence 2 BGB shall not apply if the customer is not the consumer.
  3. Services, Prices, Payment
    1. The customer is obligated to pay the agreed or applicable prices of GuestHouse Mannheim for rooms provided and for other services supplied. This also applies to services ordered by the customer directly or via GuestHouse Mannheim, which a third party provides and GuestHouse Mannheim disburses.
    2. GuestHouse Mannheim is entitled to require a reasonable advance deposit of 300€ per each night booked. During the check-out the bill can be settled with the deposit.
    3. The agreed prices include VAT. An increase in VAT after the conclusion of a contract can be charged additionally. If the period between conclusion and fulfilment of the contract exceeds more than four months, GuestHouse Mannheim can adapt the prices up to 5%.
    4. The bill needs to be settled directly after receiving it.
  4. Withdrawal/Cancellation
    1. The customer can only withdraw from the contract concluded with GuestHouse Mannheim, if a right of withdrawal was explicitly agreed upon in the contract, another statutory right of withdrawal exists or if GuestHouse Mannheim gives its explicit consent to the withdrawal.
    2. The consent to withdrawal from the contract shall be in text form.
    3. Cancellations are possible according to the following rules:
      1. Studios
        The cancellation is free up to two days before arrival. During exhibitions a cancellation is free up to 30 days of arrival. This shall not apply for non refundable rates. If the costumer cancels in less than one or 29 days before arrival or if the rooms are not used, GuestHouse Mannheim is entitled to charge the contractual agreed rate. This is not a matter of compensation but a claim for performance.
        Generally, a cancellation includes the payment of 80 percent of the booked service. If the rooms are not used, GuestHouse Mannheim charges 100 percent of the booked service.
      2. Cancellation for groups of five or more (see booking confirmation)
        Furthermore, regardless of date and reason, there is no right for a cancellation.
    4. GuestHouse Mannheim must credit the income from renting the rooms to other parties as well as for saved expenses.
    5. The customer shall be free to provide proof that the aforementioned claim did not arise or that it did not arise to the extent claimed.
  5. Room Availability, Delivery and Return
    1. The customer does not aquire the right to be provided specific rooms.
    2. Reserved rooms are available to the customer starting at 2:00 p.m on the agreed arrival date.
    3. Rooms must be vacated no later than 11:00 a.m on the agreed departure date. If the customer uses the room after 11:00 a.m, GuestHouse Mannheim can charge 50 percent of the full accomodation rate for the additional use of the room until 4:00 p.m, after 4:00 p.m even 100 percent. Clause IV paragraph five shall apply.
    4. A refund for agreed but unclaimed services is excluded.
  6. Cancellation by GuestHouse Mannheim
    1. If the required deposit is not paid by the agreed-upon deadline or within a reasonable time, GuestHouse Mannheim shall be entitled to cancel the contract and to assert damage claims.
    2. GuestHouse Mannheim is entitled to effect extraordinary withdrawal from the contract for a materially justifiable cause, in particular if:
      • force majeure or other circumstances beyond GuestHouse Mannheim's control render the fulfilment of the contract impossible
      • reservations with culpably misleading or false information or concealment regarding essential facts or other similar reasons.
    3. The withdrawal by GuestHouse Mannheim does not constitute any claims for damages for the customer. Clause VIII No.1, sentences 2 and 3 shall remain uneffected.
  7. Obligations of the Customer
    1. For damages to the room caused during the contractual period the customer adheres personally next to the causer. If the law provides a strict or fault-based liability, the cstomer adheres jointly and severally next to the causer.
    2. If the studios are used for different purposes than mentioned in the contract, GuestHouse Mannheim can cancel the contract immediately without loss of the contractually agreed rate.
    3. Pets can be brought to GuestHouse Mannheim after previous consent and a surcharge.
  8. Liability of GuestHouse Mannheim / Limitation Period
    1. GuestHouse Mannheim adheres to its contractual liabilities with the diligence of a prudent businessman. Any claims for damages for the customer are exluded. GuestHouse Mannheim is liable for harm inflicted on life, limb and physical health. Further it is liable for other damage caused with full intent or gross negligence or due to intentional or grossly negligent violation of obligations typical for the contract. A breach of obligation of GuestHouse Mannheim is deemed to be the equivalent to a breach of a statutory representative or vicarious agent. GuestHouse Mannheim is liable to the customer for property brought into the hotel in accordance with the statutory provisions (hundredfold room price) but not more than 3.500,00€. If the customer wishes to bring with him money, securities or valuables, the limit is 800,00€.
    2. Any claims for damages for the customer resulting out of wake-up calls are excluded.
    3. Items that the customer has left behind are only forwarded at the customer's request, risk and costs.If GuestHouse Mannheim does not keep such items, they will be handed over to the local lost property office, where they will be kept for no longer than six months.
    4. If the customer is provided with a parking space in the hotel garage, this does not constitute a safe-keeping arrangement, even if a fee is charged. GuestHouse Mannheim only assumes liability for loss of or damage to motor vehicles parked or manoeuvred on the property of GuestHouse Mannheim and the contents thereof pursuant to the preceding No.1 of this paragraph.
    5. All claims towards GuestHouse Mannheim become statute-barred after one year. Limitation shall begin in line with § 199 I BGB. Claims of damages without knowledge, become statute-barred after five years. This shall not apply for claims due to wilful or negligent breach of duty.
  9. Adaption Clause
    • GuestHouse Mannheim reserves the right to adapt the contract conditions agreed upon in the event of significant changes in legal regulations.
  10. Final Provisions
    1. Oral agreements shall come into effect if GuestHouse Mannheim confirms them in text form.
    2. For commercial transactions the place of performance and payment is the location of GuestHouse Mannheim.
    3. The courts at GuestHouse Mannheim. The same applies insofar as a customer does not have a legal domicile in Germany.
    4. The contract is governed by and shall be construed in accordance with the laws of the Federal Republic of Germany. The application of the UN Convention on the International Sale of Goods and the conflict of laws are precluded.
    5. Should individual provisions of these Gnereal Terms and Conditions for Hotel Accommodation Contracts be or become invalid or void, the validity of the remaining provisions shall remain unaffected thereby. The parties are obligated to replace the ineffective or unenforceable provision with an effective and enforceable provision that most closely reflects the original intent.
